The following outlines the terms and conditions of
use of the service SensibleMail.com which is a service
run by Sensible
Development Ltd . By signing up to the service
you agree to be bound by these terms and conditions.
Sensible
Development may change or withdraw any part of
our website, or may refuse you access to the website
or service at any time if we consider it necessary.
This will only be necessary if you are considered
to have contravended the terms and conditions of using
this website, or if the service adminstrators receive
a complaint regarding your behaviour. These terms
and the use of this service are governed by the laws
of England and Wales and any disputes will be decided
only by the courts of England and Wales.
Refund Policy
The Consumer Protection (Distance Selling) Regulations
2000 (SI 2000 No. 2334), transpose into UK law Directive
97/7/EC on the protection of consumers in respect
of distance contracts. The scope of the Regulations
is very broad. They cover both goods and services,
where the contract is made without any face to face
contact between supplier and consumer.
The purpose of the Directive is to increase consumer
confidence and so strengthen the single European market
by providing an agreed minimum level of consumer protection
throughout the EC. The aim of the cooling-off period
is to give consumers an opportunity to examine the
goods or services being offered, as they would have
when buying in a shop.
The right to cancel is fundamental, however this
is balanced in the Regulations by the consumer's responsibility
to take care of the goods before returning them. The
Directive does not apply to business to business transactions.

Therefore Sensible
Development offer a 'cooling-off' period of 7days
from the date of purchase in which the customer can
change their mind. This offer is given with the following
conditions:
- You inform us of your desire to cancel within
seven working days of receipt of the product(s).
- You must contact us in writing via email (our
preferred method of communication) or by post to
tell us this.
- The date of purchase is the date at which the
commitment to pay the service fee was made rather
than the date at which funds are recieved by Sensible
Development.
- You cease forthwith from using the email account
and understand the email account will be removed
from the server without preservation of the data
and email contents present on the server for that
account.
- To prevent fraudulent claims and improve security,
requests for a refund are reviewed on an individual
basis and further information may be requested from
you before any refunds are issued.
Sensible
Development has full confidence in its Sensible
Mail product and we offer a full 28 day money back
gurantee if you are unsatisfied with our services
within 28 days of signing up at the discretion of
Sensible Development.This offer is subject to the
following terms:
- The date of purchase is the date at which the
commitment to pay the service fee was made rather
than the date at which funds are recieved by Sensible
Development.
- You cease forthwith from using the email account
and understand the email account will be removed
from the server without preservation of the data
and email contents present on the server for that
account.
- To prevent fraudulent claims and improve security,
requests for a refund are reviewed on an individual
basis and further information may be requested from
you before any refunds are issued.
- Any charges incurred by Sensible Development for
the collection and/or return of subscriptions may
be deducted from any refunds.
Customers wishing to cancel their accounts must notify
Sensible Development, email or letter within 28 days
of setting up their account.
The payments described above will normally be made
by the same method used for payment or as otherwise
may be agreed.
Sensible
Development reserves the right to add, delete,
or modify any provision of this policy at any time
without notice.
Payment and Security
We accept the following forms of online payment
for our email service via who provide a secure server
and payment pages.
Sensible
Development use the services of
WorldPay.co.uk that provide high security servers
to encrypt and process online credit card details
securely while you make your payments. We do not hold
any credit card details on our servers. We accept
the following currencies GBP, EUR and USD and we accept
the following cards for online payment:
Charges for goods shall be those ruling on the date
of order. Fees & prices are those shown and may be
subject to change without notice and include British
VAT if and where applicable.
Referral Policy
For every customer you recommend to Sensible Mail
will will give you £2.50 (GBP). The following terms
and conditions apply:
- The referring person must already be a fully signed
and paid up member of the Sensible Mail service.
- The email address of the referrer must be entered
by the new customer in the box labeled "Enter
Sensible Mail referrer here", and the option
"An existing SensibleMail user" must be
selected in the box labeled "How did you hear
about us?".
- Payment will be made when Sensible Development
Ltd, who manage the SensibleMail service receive
cleared funds from the newly referred customer.
- Referrals will not be paid, due or made in any
other way.
- Referral payments will normally be made by the
same method used for payment or as otherwise may
be agreed.
Anti Spam Policy and SMTP Mail Sending Policy
Anti Spam Policy
Spam is not merely annoying: it is also a serious
drain on the resources of ISPs, other organizations,
and Internet users. Sending Spam mail may seem like
a cheap and convenient way to amplify marketing efforts,
yet honest businesses rarely employ this questionable
marketing tool. Firstly, nobody wishes to receive
unsolicited junk mail. Secondly, it is considered
both an annoyance and an intrusion of privacy. Thirdly,
each sent e-mail message contributes to Internet traffic
and uses up bandwidth.
Therefore Sensible Development strictly prohibits
members from sending unsolicited mass emails or spam,
whether via email, Usenet or any other form using
Sensible Development servers. Any member using spamming
techniques for soliciting referrals will be have their
account terminated forthwith, without refund, and
without preservation of any data on the host server.
If this falls within any of the periods described
in our "Refund Policy", the anti spam policy
will overide any of those policies decsribed in the
aforementioned "Refund Policy". In addition,
their mailing address will be ineligible for opening
a new membership account.
SMTP Mail Sending Policy
As a result we have therefore developed this SMTP
mail sending policy in an attempt to cut down on Spam.
Our services have restricted access to it's mail sending
(SMTP) services. We don't restrict SMTP access as
far as how many messages you send, the size of the
messages or even how many recipients you specify.
Instead, we simply require that access to our SMTP
service be from accounts on our systems. You will
probably not even notice the measures we've taken
to protect our SMTP servers from illegimate use but
occasionally you might receive an error message upon
sending email.
If you try to send an email and receive the following
error message, you were not authorized to use our
SMTP services. "sorry, that domain isn't in my list
of allowed rcpthosts (#5.7.1)" In order to get around
this you have do one of three things:
1. Configure your email client for SMTP authentication
- see out help for more information
on how to do this.
2. Check your email account before attempting to
send mail.
3. Use your dial-up/broadband ISP's SMTP server.
Indemnity
As a condition of use of the Website, you agree to
indemnify Sensible Development Ltd and its affiliates,
officers, employees and agents from and against any
and all liabilities, expenses (including attorneys'
fees) and damages arising out of claims resulting
from your use of the Website.
Mailbox size
We do not offer this service with any hard limits
on the size of the mailboxes you purchase. This provides
you with the flexibility to use the maibox within
reasonable limits. If your mailbox expands beyond
reasonable and practical bounds then we will contact
you to discuss your usage.
VAT (Value Added Tax)
UK VAT at the current rate of 17.5% is included
for appropriate subscriptions listed on this web site.
All UK and EU customers are required to pay UK VAT.
UK and EU based customers who are VAT-registered can
claim VAT value back through your own country's tax
authorities, if applicable.
